Probably thanks to the US election funding MPAA and RIAA have been able to obtain exclusive rights of obscene length at the cost of society and voters/consumers/users.
The problem is that Megaupload was merely a distribution network, not "pirates," and they would remove copyrighted content when asked to do so. I would equate what Megaupload did to what the postal service does, which is delivering "packages" from point A to point B. For example, some people choose to send illegal drugs through the mail, however, just because the post office (unknowingly) ships the items it doesn't make the postal service liable or a drug distribution network, even in the eyes of the (insanely overzealous) DOJ.
the Megaupload TOS specifically outlaws copyrighted files. You can't hold the owners responsible for their members breaking the ToS, they can only work so much to uphold it, if companies want a file taken down they can report it.
They complied with ALL provisions of the DMCA. You cannot easily moderate users on any website...they can ALWAYS find ways around stuff. Response is key...and Megaupload did the best they could.
we should all write to our congressman and tell them that if they don't issue a direct order to the FBI to release the megaupload owners and return the website we'll vote them out of office come next election. Complete with a signed petition.
It isn't fair to arrest website owners because users don't follow the TOS, I'm against online piracy as much as anyone but attacks against our freedom is disgraceful and should be met with retaliation. I may not be a member of anonymous but what they are doing is well within our rights (I believe the constitution mentions the people's right to overthrow a corrupt and inadequate government).
They have those, it's called a court and the DMCA. These guys aren't even US citizens. Mexico has a rampant drug cartel problem and we're doing nothing to help them out. This was simply and purely for the benefit of media companies and the 1%.
The USA, at great expense, has sent officials for training the police and military, and weapons to Mexico. The War on Drugs ring any Bells. Many weapons supplied to the military, have wound up in drug cartels hands.
Not to mention Holder and Bush sending guns to the Cartels.
Seems a little defeatist to help both sides, but that's how the stupid people in our government work.
And you are correct, "a court and the DMCA" would easily be enough to shut down the servers hosting the pirated media from the "media companies and the 1%." But who would enforce this after trail, the FBI. Did the FBI subvert the law, it would appear so, but for 30 + years the government has done what they want, just now, finally, enough people are getting pissed about it.
