Isn't anyone bothered by the fact that a "hard drive transfer" does not require the viewing of any .jpg files by the technician? Best Buy annointed themselves as deputies of the local police force and then performed an unwarranted search. Perhaps we're not so liberal here after all.
A comment on the story brought up a good point that I think is being missed here. If the family computer was infected with spyware, malware, and possibly trojans, their machine could have been hijacked and used as a torrent node full of illegal stuff. That would mean the guy in question (why is it always the guy that gets looked at, and never the woman?) may not have gone out seeking child porn.
I'm willing to bet that Geek Squad and the local police are not technically competent enough to identify such a situation, so unless the guy confesses (ie, he really did download all that stuff), he would be smart to get a good tech lawyer.
Too often people just jump to conclusions, but if a person is not very good with computers and someone else didn't take the time to setup all the needed firewalls, anti-virus, etc, it is pretty easy for more nefarious organizations to co-opt your Windows system before you know what has happened.
