"Livingston has done everything from talk to his local branch to emailing Bank of America's CEO Brian Moynihan two weeks ago, only to have company representatives tell him his issue has been bounced around or "escalated."

How about getting a lawyer and suing them? They are breaking the law by reporting flase information to the credit agencies. If you hit them where it hurts, they'll fix it as fast as they can.

Or, maybe a much cheaper route, go to any local business that can do a credit check for a purchase. Every time the agencies come back with the deceased result is another case. Sue them in small claims court for every false report. It may take some paperwork but it will get the same thing done.

He should move his account to a local credit union and report Bank of America to the Consumer Financial Protection Bureau and the FTC.

With your digg.com ID being "barackalypse", you're most likely a republican and as such you're going to sympathize with big banks. If a bank makes a problem, big or small, they should do whatever they can as fast as they can to rectify it. What if you order a burger from McD's and you wanted no pickle on it and they gave you a burger with pickle, you complain and McD's tells you "we are looking into it and we will let you know", would you be as sympathetic? McD's has hundreds of millions of customers too. You're a moron.

Yeah, I read the article, but the Law is on his side. He doesn't even need to approach BoA directly-- just file a dispute with the major credit reporting agencies in writing.

In the article he says that he doesn't want to move from BoA yet cause if this is the treatment he gets as a customer imagine what help he'll get as a non customer.

I said in my very first sentence that they made a mistake. If it happened to me it wouldn't be terrible critical because I have 4 different banks that I use, one of which is located in another Country. I'd simply ask to speak to the manager, and if they couldn't resolve the situation I'd file a complaint with the Federal Reserve, my State's Attorney General and let the regulatory apparatus do its job, and for vindictive measure I'd phone up one of the local news channels consumer reporters (as you can guess from this article, they love dramatic s**t like this).

All I said was that they made a mistake, but with the amount of customers they have its bound to happen. Obviously they should fix their mistake with as little hassle to the customer as possible. I'm going to guess that the reason this is a story is because it hasn't proven easy to resolve, in which case perhaps its time to seek an attorney or Government regulators or the local news channels consumer reporter.

perhaps bank of america is run by an organized crime syndicate and they are going to knock this guy off and just got ahead of the paperwork

kidding aside, in the short term wouldn't it be possible to run the numbers based on his wife's financial info? obviously it shouldn't be necessary and bank of america should fix their mistake, but at least that could get the building process started
